No. 185 The State of South Carolina Know all men by these presents that I Joseph Cathcart of Chester County in the State aforesaid, planter in consideration of two Hundred Dollars to me paid by John Cathcart of said state and county, planter, Has granted bargained and sold and Released and by these Presents do Grant Bargain Sell and release unto the said John Cathcart a plantation or tract of land containing seventy five acres now situated in Chester County on both sides of Fishing Creek being one part of a tract of land. Land of one hundred an fifty acres originally granted unto Peter Culp and by him divided by Will to Jno Culp and by him conveyed unto Philip Cline and by him conveyed unto Thomas Miller. Beginning on a White oak on the South side of Fishing Creek on ___ Letter line and with said line N 30 E 23.79 to a White oak ___ marked thence South 50 E 31-62 to a stake thence South 30 W 23.72 to a stake thence N 60 W 31.62 on Jno Culp's line to the Beginning. Together with all and Singular the Rights members hereditaments and appurtenances to the said Premises belonging or in any wise incident or appertaining. No. 72 South Carolina To all to whom these presents shall come, I John Cathcart, Farmer, of Chester District in the state aforesaid send Greetings. Whereas I, this said John Cathcart am justly indebted to Moses Lamont the sum of fifty seven Dollars and fifty Cents by my note of hand or obligation Bearing Date the 29th day of October in the year of our Lord one Thousand Eight Hundred and Six with Interest thereon as I the said promissory note or obligation Relation thereunto being had doth now fully and at large appear Now Know Ye that I the said John Cathcart for the better serving the payment of the said sum above mentioned unto the said Moses Lamont, his heirs Executors Administrators or assigns together with lawful interest for the same have bargained and sold and by these presents to bargain and sell and in plain and open market deliver unto the said Moses Lamont one Waggon & [Game] of furniture belonging thereunto to have and to hold the said Waggon and furniture and [Game] unto the said Moses Lamont his heirs, Executors and Administrators and assigns for ever. Provided always nonetheless that if the said John Cathcart his heirs executors or Administrators shall and do well and truly pay or cause to be paid unto the said Moses Lamont, his [certain] attorney Executor Administrator or assigns the full and just sum above mentioned according to the true meaning and interest of the Note aforesaid and of these presents through this [Instrument] of Bargain and Sale and all and every Clause Statute and thing therein contained shall cease [determine] and be utterly void and of None Effect any thing herein before Contained to the Contrary thereof ____ notwithstanding and it is hereby ____ by and between the said parties and that John Cathcart for himself his heirs Executors Administrators and assigns doth Covenant promise and agree to and with the said Moses Lamont his heirs Executors Administrators and assigns by these presents that if Default shall happen to be made of or in payment of the said sum abovementioned according to the true intent and meaning of the said note that then and in said case, it shall and may be lawful to and for the said Moses Lamont his heirs Executors Administrators Assigns Attorneys or Agents from time to time and at any time hereafter [peaceably] and quietly to take into any or all the _____ Lands or Tenements of the said John Cathcart and to take the said Waggon Gins & furniture and it is hereby covenanted & agreed upon by and between the parties to these presents that if the said John Cathcart shall pay or cause to be paid the said note of hand unto the said Moses Lamont or assigns against the 20th day of September Eighteen Hundred and ten and the Interest due through this Mortgage & any pact thereof to be void & of none Effect otherwise the said Moses Lamont may take the said Waggon and furniture belonging thereto into his Custody and possession and the same to hold and detain to his own use and to have as his own, property Goods and Chattels from thenceforth and for ever or the same to sell and dispose of at his pleasure and while returning the ____ of any should happen to be after paying of sum above mentioned unto the said John Cathcart his heirs Executors administrators or assigns. No. 492 The State of South Carolina Know all men by these presents that I John Keys of the District of Chester and State aforesaid in consideration of the sum of five hundred dollars to me in hand paid by Robert Cathcart of the town of Winnsborough in the District of Fairfield & state aforesaid have granted bargained sold exchanged & do by these presents bargain sell and release unto the said Robert Cathcart all that plantation or tract of land containing eighty acres or less ... on the waters of Rocky Creek on the south side of the said Creek being composed of those ___ parcels of land ___ past about sixty five acres conveyed from George and Agnes Keys to me the eight day of March 1807[?] and another part about eight or nine acres conveyed to me by the said George Keys the fifth day of May in the year of our Lord one thousand eight hundred & three and also ___ part containing about six acres being part of the tract of land being part of a grant of land formerly belonging to Stephen and Robert [Kammon?] and conveyed from them to me 14th December 1811[?] being the plantation on which I now live. Together with all and Singular the Rights numbers, ____ apportionments to the said premises belonging on in any...appertaining. No. 93 [Has Platt drawn out] South Carolina, Chester District } at the request of James Preston and by permission of Robert Cathcart, I have administered and resurveyed the above delineated plat or tract of land containing seventy three and one half acres lying and being on Big Rocky Creek Waters of the Catawba River and District of Chester being part of a tract of land granted to William Pickens and Griffith Rutherford the third day of October 1755 and hath such shape and mark as the above Platt represents Resurveyed February 26th 1823 James Kennedy, DJ[?] The State of South Carolina -- Know all men by these presents that I, James Cathcart Senior of Fairfield District in the state aforesaid in consideration of five hundred & eighty eight Dollars to me paid by James A. Preston in the state aforesaid have granted, bargained sold and released and by these presents do grant bargain sell and release unto the said James A. Whereas by virtue of a writ of fieri facias issued out of the Court of Common Pleas held for the District of Chester, listed the ninth day of April in the year of our Lord one thousand eight hundred and forty two at the Suit of Matlock & Adams vs. Alexander Rosborough to me directed commanding me that of the goods and chattels lands and tenaments [sic] of Alexander Rosborough to levy the sum of Eleven hundred & Ninety Seven dollars12 cents damages and costs. I have seized and taken of the lands and tenaments of the said Alexander Rosborough all that certain piece parcel and tract of land containing four hundred acres more or less, situate and being in the district of Chester whereon Alexander Rosborough now lives. Joining lands of Major John Moore, Henry McHenry and John Rosborough. David Cathcart is later found in records of Monroe County, Tenn., where Joseph Sr. moved and is buried, David shown 1823/24/25/26." [There is a David buried in Ebenezer (1794-1809) that I think is connected with the William/Mary Cathcart line.] |

The signatures and witness statements, at the end of the document, are correctly spelled as CATHCART. 2. The 20-year lapse of time between signing and recording (1811-1831) is puzzling. I'll have to look into this. The State of South Carolina } Know all men by these presents that I John Kincart of Fairfield District and State of South Carolina for & in consideration of the sum of three hundred & fifty Dollars to me in hand paid by Samuel Kincart of the District & State aforesaid the receipt hereof I do hereby acknowledge, have granted bargained sold released & by these presents do grant bargain sell & release unto the said Samuel Kincart all that plantation or tract of Land containing two hundred acres, [excepting?] one given by Robert Carnaughen for the use of the Presbyterian Society originally granted to Robert Carnaughen the sixth day of February in the year one Thousand, seven hundred & eighty six, & hath a memorial thereof entered in the secretary's office in grant book FFFF page 21, said Land situate in, then, Camden District on the waters of Little River, & hath such form & marks [buildings & boundaries] as appears in the plat hereof, annexed to the Original Grant, Together with all the rights, members hereditaments & appurtenances to the said premises belonging or in any wise incident or appertaining, to have & to hold all & singular the premises before mentioned unto the said Samuel Kincart, his heirs & assigns for ever, and I, the said John Kincart, do hereby bind myself, my heirs executors assigns or administrators to Warrant and to forever defend all & Singular the premises unto the said Samuel Kincart his heirs and assigns for ever against myself my heirs & assigns and against all & every other person or persons whomsoever, Lawfully claiming or to claim the same or any part thereof. ~ Witness my hand & seal the 12th day of October in the year one thousand eight hundred & Eleven, & in the thirty sixth year of the Independence of the United States of America ~ Signed sealed and Delivered in the presence of David Cathcart ~ Hugh Stevenson} John Cathcart (SS) South Carolina } Col.l [sic] Hugh

State of North Carolina Mecklenburg County Inquisition indented taken at the dwelling house of James McNight in the County aforesaid the 31st day of March 1808 before us George W Smart and James Fagert two of the Justices of the Peace of the said County upon the view of the body of Jacob a slave, the property of Joseph Spratt after his decease in possession of Thomas Spratt whom they had all seen lying dead and upon the oath of Daniel Smith, John Porter, William Todd, John Berryhill, Samuel Berryhill, John Hepworth, John Taylor, William Campbell, Joseph Wilson, John Cathcart, John Barnett and William Porter the good and lawful men of the County aforesaid who being charged and sworn to inquire how and in what manner the said slave by his death came who was found lying near the dwelling house of Hugh McDowell on the 19th of this Instant early in the morning alive with a large wound in his for head of new nearly 2 inches... [The next line is at the fold of the page and is not legible] and from he could not speak when found and died that day and the jury on this matter to save they think he came by his death in a violent way and the jury did say that they have strong ____to believe from the evidence they have got that Moses a slave the property of James McKnight and asked for I am the property of Hugh Parker and James the property of James Spratt Esq. perpetrated the said crime and the strongest presumption is that it was either Ephraim or Moses. In testimony whereof we the said justice as well as the jurors to the Inquisition have several just a fixed and seal the day year and place first above mentioned. |
